Black People Politics : Voting: The Illusion of Choice "HOT TOPIC"

Unfortunately, no it doesn't make me happy because there is no real danger to Trump of this argument working.

The sad reality is that Trump has so much dirt that it drowns out all of his dirt. It's weird because it's the only time we've really seen this. His cult following doesn't listen to any of it and instead believes him when he says he's a victim; thus pushing the "dirtiness" of all the dirt onto those trying to uphold the law and hold him accountable. It's like how no one cares that Robin Hood is a criminal because he's famous for robbing the rich and giving to the poor. But Donald Trump robs the poor and gives tax cuts to the rich. And the poor love him for this because he lies to them and acts like he's Robin Hood against an evil Sheriff.

It is truly amazing. If he wasn't so viscerally stupid on the surface I might even think somehow this man could be a genius. But the reality is that his bumbling trailer park mental disorder word salad speeches are the product of an addled brain. The perception of genius is carefully created by all the wealthy and powerful individuals that should be called "elites" but aren't only because they're not Democrats. But they have continued to build a wall around Trump in such a way that it truly makes him bulletproof. And so Trump won't truly ever bleed until they retract their protective fore field. They love Trump because he's a sell-out who will take orders from them like Papa John's. They love that he's corrupt because that means they can corrupt him and the cost of doing that business is relatively cheap because Trump, on his own, has an illusion of wealth but is tangibly broke. But that is an advantage in his current position. His current position will not change until he LOSES.

So here's the sad reality.

The rule of law in the United States, for Trump, has been suspended. Legal excuses will be made up later. They have already decided to "leave the decision up to the voters". So Trump is not going to go out on some technicality. We're way past that. He should have been prosecuted for Jan 6th. So why did everyone ELSE get in trouble?

Because he was POTUS.

It's the same with the government. Trying to sue the Federal government is almost impossible. In practice, this makes the government only liable for little things like traffic accidents so you can get compensation:

This same type of legal protection is also applied to the figurehead of the government. If Trump runs you over the Federal government would probably pay for the damages (and would settle out of court). But do you think Trump would go to jail for it? Of course not. The Supreme Court recently made similar rulings on questions brought up by Trump's lawyers. They may not be the smartest most articulate bunch but they they understand this legal construct and they understand the judges who can find enough room in it to swing their way. Therefore, unless he did something bad OUT OF OFFICE, he's practically untouchable. That's why his current felonies are related to state law that he broke before becoming POTUS.

Jan 6 happened while he was POTUS. Therefore, the legal argument will be that Trump did not order an insurrection and could not order an insurrection against "himself". Because he was the sitting president at the time and therefore they were attacking his government and even threatening to hang his Vice President. Now we can make whatever rhetorical arguments against this, but I'm telling you what will happen if it actually went to trial and that trial would be delayed way past the election.

So that means, state officials would have to decide on their own whether or not to drop Trump from the ballot but how can they do that without a court ruling saying he is guilty of the insurrection? They're not. There is no legal basis that this would go forward. He would have to be charged and convicted of the crime for which he could be pulled off the ballot for. This will not happen.

Trump himself faces 91 charges across four cases, two of which are related to his efforts to overturn the 2020 election. But insurrection is not among the charges, and he was acquitted by the Senate after the House impeached him on charges that included inciting an insurrection. Trump and his supporters say the lack of insurrection charges shows that the term does not apply.

If any state officials attempted to drop Trump from the ballot they would get sued and the election results would be contested. This would either lead to a constitutional crisis or a similar result to Bush v. Gore. But the reason I say constitutional crisis is because Bush v Gore was decided by the Supreme Court and went to Bush (Republican). At this point, it is no secret how corrupt our Supreme Court is. It's so corrupt that a POTUS could actually withstand the backlash of suggesting term limits; which is like the Executive branch walking up to the Judicial Branch and slapping it with a leather glove. This court may find in favor of Trump. But it won't even come to that because the states that would consider dropping Trump are also smart enough to see what will happen if they do. So at the end of the day, they're going to leave it to the voters and hope for a Kamala win on just the merits of her case.

In America, we need to understand and remember that you can be guilty as sin, but if you either don't get caught or the prosecution decides not to go after you, it doesn't matter. This is why he's legally unstoppable. Even if he gets sentenced to jail time it's probably going to be set to only start after he leaves office and it will most likely be house arrest because of his age and lack of priors. Why are they postponing his sentencing? To wait to see if he's going to be in office during his sentence.

Me either IPXninja, sigh...!

we done been distracted....
Nope! This is not a distraction, James!

Of the three branches the resolution of this disqualification issue will show just how the judicial & legislative branch work to promote the executive branch.

This event has only happened a few times in the American defacto system.

The precedent for 14th Amendment disqualification

July 7, 2023
Updated August 17, 2023

"...Section 3, also known as the Disqualification Clause, has gained new relevance in the wake of the January 6th insurrection, when a violent mob that then-President Trump summoned and urged to “fight like hell” seized the United States Capitol to disrupt the peaceful transition of power. Adopted after the Civil War to protect American democracy from those who sought to destroy it, Section 3 disqualifies from office anyone who swore an oath to support the Constitution as a federal or state officer and then engaged in insurrection or rebellion against it, unless Congress removes the disqualification by a two-thirds vote..."

Eye don't want to get too happy, because Eye know how English words can switch meaning to fit whichever direction the gub'ment is flying.

Supreme Court "trumps" ALL the states

There's really nothing to see here. Beating Trump is only going to happen at the ballot box so it's going to be another 2008 all hands on deck situation.

No this is different, IPXninja.

According to the wording of Amendment 24: Section 3:

"...only Congress can remove the disqualification by a two-thirds vote..."

The supreme court does not trump all states. Congress has the final say.

my background education on the constitution used to be very thin and edgy.

Dang, it's like everything else that Eye have self-gathered in adulthood and that is, Eye have had to go back and re-learn what Eye was vaguely taught, smh.

Better late than never...because self education is the boost best qualified to bump up the process of relearning.

Dear IPXninja, Eye am not sure if you even like Malcolm X, but here it goes:

"...Of all our studies, history is best qualified to reward our research..."

If this defacto government cannot follow its own rules what good is it?
