    Davis was shot and killed by officer Clayton Sutton in the parking lot of Kroger on Pio Nono Avenue. Inconsistencies in police reports have drawn public scrutiny and prompted a visit of Macon Mayor Robert Reichert to the Davis family.

    In a release to WGXA, Reichert explains his reason for the visit, saying quote.

    "As mayor, I felt it my duty to visit with Mr. Davis' family and to assure them - and the community - that an appropriate investigation would be conducted."

    According to Chris Floore ,the file's has been delivered to the district attorney's office for their review and determination of whether any criminal conduct was involved. additional information, such as toxicology and forensic reports, are still pending and will be turned over for their review upon receipt.

    The investigation into the Dec. 21 fatal shooting of a man outside the Kroger grocery store on Pio Nono Avenue will be turned over to the GBI for a third-party review.
    New Bibb County District Attorney David Cooke said he met with police Monday.
    “We went over the case very thoroughly,” he said.
    Macon police Officer Clayton Sutton fatally shot 49-year-old Sammie Davis Jr. while at the grocery store responding to a call for service involving Davis.
    Police haven’t released details of what transpired before Sutton shot Davis three times in the chest.
    Sutton told officers he had been cut, but when police searched Davis, they didn’t find a weapon.
    Cooke said he plans to request the GBI’s help early Tuesday morning.
    “I think it’s important in a case of this type that a neutral third-party reviews the facts and circumstances,” he said.
    Results of the GBI’s probe will influence whether the district attorney’s office files criminal charges in the case....

    TWO MACON COUNTY COUNCIL MEMBERS SPEAK OUT ON DAVIS SHOOTING

    1:02 PM, Jan 1, 2013

    Two Macon City Council members say police have mishandled the investigation of a officer's fatal shooting of an unarmed man.

    Henry Gibson and Henry Ficklin spoke out Monday after police andBibb County's new district attorney said they've asked the GBIto look into the case.

    Sammie Davis Jr. died on Dec. 21, about an hour after Officer Clayton Sutton shot him three times.

    ....On Monday, Ficklin released a letter he sent today to Mayor Robert Reichert.
    He asked

    • Why the officer used deadly force;
    • Why the internal investigation took more than a week;
    • Why police initially said the officer was serving a warrant on Davis...which was wrong;
    • Why police have not interviewed all the witnesses to the shooting.

    ...Last week, 13WMAZ reported how Officer Clayton Sutton had beendisciplined more than a dozen times in less than six years.

    He's been accused of excessive force, rudeness, intimidating the public and being invlvled in several cruiser accidents.

    Police have declined to discuss his record.

    Sutton remains on administrative leave.
