the near north
his shirt was torn
body, covered in sweat
breathing hard
hair dirty and wet
his eyes were wild
with alcoholic breath
well over the limit
when they gave him the test

they threw him to the ground
put a knee in his back
handcuffed the brutha
read him the riot act
"you're under arrest"
they said with disdain
slapped him
kicked him
before the others came

"why're you arresting me?
i've done nothing wrong.
i had a few drinks
fell…
on my way home."

"you're under arrest
for rape and assault
you trying to deny it
claiming it's not your fault"

they took him to the precinct
lined him up against a wall
then lined up some others
before making the call

"that's him,
the bastard"
that woman did say

"it wasn't me
i promise"
he didn't know what to say

her words were like fire
burning hot
in his soul
"i didn't do it"
he shouted
but his fate had been told
by the look in her eyes
overflowing with tears
"it wasn't me" he knew
but ahead were many years
of a six by eight cell
a
bed
and
a
stool
a mirror made of mettle
suicides were too cruel

his future washed over him
"how wrong can this be"
as he realized the inevitable
he'd no longer be free

the trial came down
a formality...that's all
a week long process
before he got the call

"GUILTY"

they charged
pointing daggers at him
"twenty-five to life
for his terrible sin"

"BUT IT WASN'T ME"

he wept in his seat
as the verdict was read
"how could the jury
could have been misled
why couldn't they see
i didn't do this thing
i'm sad for this woman
but it wasn't me."

the first year was the hardest
the second...so, so
then five
and ten
he had no place to go

sometime, in year eleven
his lawyer stopped by
"we wanna try this new technique
would you give it a try
it's called DNA testing
of the semen in her
when the crime was committed"
his mind was in a blur
"**** right, i wanna try it
i said it wasn't me
get a judge
get a doctor
do the test
you'll see"

when the testing was over
he was vindicated and set free
twelve years to the day
when he was found guilty

"i told you
didn't i tell you"
he cried profusely

“twelve years

ain’t that a *****
why'd she have ta accuse me?”

****!

TOO MANY OF OUR BRETHREN BE UNJUSTLY INCARCERATED.

baller, I hear you on this one. I had a cousin accused of the same thing, served 18 months before they realized he didn't do it. But instead of setting him free, they had to put him on home monitoring for 2 years, because it was a slow process in clearing his record. He still hasn't healed from the injustice done to him....
