    The latest device for openness avoidance is the use of personal email accounts (and, increasingly, text messaging too) for government communications. Mayors, city council members, agency executives and school superintendents have been told that if they do government business on their gmail or yahoo accounts–anything but their official .gov email–their communications, no matter how focused on government matters, will never see the light of day.

    What do your elected representatives do when they believe that their messages about government business are secret? In San Jose, city council members, like proverbial puppets on a string, take instructions during council meetings on how to vote, according to a San Jose Mercury News report on text messages sent by representatives of unions and other special interests.

    The former San Bernardino County Assessor, who was arrested on drug charges and is under grand jury investigation, used electronic messaging on personal cell phones to direct his staff in partisan political activities...

    HSBC: Too Big To Prosecute?

    Europe's largest bank will avoid a potentially crippling criminal prosecution for its role in moving cash for known terror groups, Mexican drug cartels, and rogue governments such as Iran, instead agreeing to pay a record $2 billion settlement, U.S. Justice Department officials announced at a press conference today.

    Critics of the settlement said Tuesday that the government had missed a rare chance to send an unmistakable signal about the threat posed by financial institutions willing to assist drug lords and terror groups in moving their money.

    The U.S Attorney for the Eastern District of New York Loretta Lynch told reporters today that HSBC ignored "numerous red flags and warnings about the money laundering risks."

    Former US Deputy Attorney General joins HSBC Board

    James Brien Comey, Jr. (52), former United States Deputy Attorney General, has been appointed a Director of HSBC Holdings plc with effect from 4 March 2013. He will be an independent non-executive Director and a member of the Financial System Vulnerabilities Committee.

    Commenting on the appointment, HSBC Group Chairman Douglas Flint said: “We are delighted to welcome Jim as a non-executive Director and a member of our new Financial System Vulnerabilities Committee.     Three years ago, then-U.S. Attorney of the Eastern District of New York Loretta Lynch crafted a soft-touch deferred-prosecution deal for Europe's largest bank, HSBC, which had only been caught in the largest drug-money-laundering case in history.

    Today, as Lynch awaits approval for the Attorney General job, HSBC is in the news again. This time, the global mega-bank is being exposed in a massive scheme to help wealthy clients avoid taxes. This is from the New York Times:

    In a report released on Sunday, the International Consortium of Investigative Journalists… said that secret documents revealed that bank employees had reassured clients that HSBC would not disclose details of their accounts to tax authorities in their home countries and discussed options to avoid paying taxes on those assets.

    Loretta Lynch to Accept F.B.I. Recommendations in Clinton Email Inquiry

    WASHINGTON — Attorney General Loretta E. Lynch, conceding that her airport meeting with former President Bill Clinton this week had cast a shadow over the federal investigation of Hillary Clinton’s personal email account, said Friday that she would accept whatever recommendations career prosecutors and the F.B.I. director made about whether to bring charges in the case.

    Ms. Lynch said she had decided this spring to defer to the recommendations of her staff and the F.B.I. because her status as a political appointee sitting in judgment on a politically charged case would raise questions of a conflict of interest.

    In a move that was so quick it even surprised even the plaintiff, Judge Donald Middlebrooks of the U.S. District Court for the Southern District of Florida scheduled a January 20th, 2016 trial date for the RICO lawsuit against Bill and Hillary Clinton and the Clinton Foundation (RICO stands for racketeering, influenced and corrupt organizations and was originally created to enable the Justice Department to convict organized crime figures).​

    In an interview with MSNBC's Thomas Roberts on Friday, Rep. Nancy Pelosi was asked how Hillary Clinton can say she is "fighting for the deck that she says is stacked at the top" while her husband, former President Bill Clinton, was paid $500,000 to speak at a charity dinner last year to commemorate the 2004 Indian Ocean tsunami.

    Clinton depositions blocked by judge
    July 21, 2015

    A federal judge in Florida has blocked a scheduled deposition of Democratic presidential candidate Hillary Rodham Clinton and her husband, former President Bill Clinton, in a civil lawsuit claiming the Clinton Foundation operated as a criminal enterprise.

    The conservative watchdog group Freedom Watch, which brought the lawsuit against the Clintons, had scheduled separate videotaped depositions next week in Washington for the former president and first lady.

    U.S. District Court Judge Donald Middlebrooks on Tuesday granted a protective order requested by the Clintons’ lawyers that blocked the depositions until the court resolves their pending motion to dismiss the case and halt discovery. The judge’s order did not include the reasoning for his decision.​

    Judge dismisses racketeering case against Clintons
    August 11, 2015

    A federal judge has dismissed a racketeering case accusing former Secretary of State Hillary Clinton of giving out official favors in exchange for financial contributions to her family foundation.

    The long-shot lawsuit from conservative legal activist Larry Klayman was filed in March and tossed out Tuesday because Klayman did not have standing to sue and was unable to show the depth of the Clintons' alleged criminal enterprise.

    Klayman’s court filings do “not allege any facts” to support his claim that he has been hurt by the Clintons’ alleged scheme, Judge Donald Middlebrooks wrote.

    A federal judge has denied the government's request to halt production of records in two Freedom of Information Act lawsuits seeking records about top aides to former secretary of state Hillary Clinton.

    U.S. District Court Judge Emmet Sullivan issued a pair of orders Friday afternoon rejecting the Justice Department's motion to stay the cases brought by conservative groups Citizens United and Judicial Watch until a decision is reached on a broader motion seeking to coordinate more than 30 pending lawsuits involving emails on private accounts maintained by Clinton and her close aides.

    In the Citizens United case, the group was scheduled to get by Monday all correspondence between Clinton aides Cheryl Mills and Huma Abedin and the Clinton Foundation, the lobbying firm Teneo and various related individuals. Sullivan said there was no reason to lift that deadline agreed to in May.

    Federal judge opens the door to Clinton deposition in email case
    May 4, 2016

    A federal judge on Wednesday opened the door to interviewing Democratic presidential front-runner Hillary Clinton as part of a review into her use of a private email server while secretary of State.

    Judge Emmet Sullivan of the U.S. District Court for the District of Columbia laid out the ground rules for interviewing multiple State Department officials about the emails, with an eye toward finishing the depositions in the weeks before the party nominating conventions.

    Clinton herself may be forced to answer questions under oath, Sullivan said, though she is not yet being forced to take that step.

    “Based on information learned during discovery, the deposition of Mrs. Clinton may be necessary,” Sullivan said in an order on Wednesday. [READ THE ORDER BELOW] Discovery is the formal name for the evidence-gathering process, which includes depositions.​

    The judge also ordered the State Department to prepare a formal answer about Clinton’s emails. Donald Reid, a senior security official, may also be asked to answer questions, if Judicial Watch so decides.

    That process is scheduled to be wrapped up within eight weeks, putting the deadline in the final week of June.

    Clinton tech aide takes 5th in deposition
    June 22, 2016

    A former computer technology aide to Hillary Clinton repeatedly invoked the Fifth Amendment Wednesday during a court-ordered deposition in a lawsuit related to Clinton's private email set-up, according a conservative group pressing the legal case.

    Tech specialist Bryan Pagliano asserted his constitutional right against self-incrimination "more than 125 times" during the testimony, Judicial Watch president Tom Fitton said in an interview.​

    Mr. Comey refused to answer a question from the committee chairman about whether the investigation the bureau conducted extended to the Clinton Foundation, which has faced questions about donations from foreign officials seeking to influence American policy.

    “I’m not going to comment on the existence or nonexistence of other investigations,” he said.

    “Was the Clinton Foundation tied into this investigation?” Mr. Chaffetz asked.

    Judge sets hearing on demand for Hillary Clinton deposition
    July 8, 2016

    A federal judge has set a hearing for later this month on a conservative group's demand that Hillary Clinton testify in a civil lawsuit relating to the home-based email server she used as secretary of state.

    After Judicial Watch made the request Friday afternoon, U.S. District Court Judge Emmet Sullivan almost immediately ordered the government to respond by Tuesday and he set a hearing on the issue for July 18. That happens to be the first day of the Republican National Convention and a week before the opening of the Democratic National Convention, where Clinton is expected to receive the Democratic presidential nomination.​

    Clinton legal team moves to block deposition in email lawsuit

    Lawyers for Hillary Clinton are going to federal court for the first time to block efforts to force her to testify in a civil lawsuit related to her private email set-up.

    Clinton's attorneys submitted a legal filing Tuesday morning in a bid to shut down a conservative group's request for an order forcing her to submit to a deposition in the midst of her presidential campaign.

    Clinton’s legal team said her testimony was unnecessary and superfluous in light of her questioning before the House Benghazi Committee last October and several State Department inquiries into the issue.​

    State Department proposes delay on Clinton deposition request

    The State Department is proposing that a federal judge postpone a politically sensitive decision on whether to require Hillary Clinton to submit to a court-ordered deposition about her private email set-up as she enters a critical phase of her campaign for the White House.

    Justice Department lawyers representing State are still urging U.S. District Court Judge Emmet Sullivan to deny a request from the conservative group Judicial Watch to depose the presumptive Democratic presidential nominee and two other witnesses in connection with a Freedom of Information Act lawsuit.

    However, in a new court filing Friday, State says Sullivan could put off a decision on further depositions because State has been promised more Clinton emails shortly from the FBI and those records could contain information Judicial Watch is looking for.​

    A federal judge on Monday declined to order the deposition of Hillary Clinton over whether she deliberately thwarted federal record-keeping laws — but did not rule out the possibility that the former secretary of State may yet be forced to testify.

    In his book State of War, author and intelligence correspondent for The New York Times James Risen relates that the CIA chose a defected Russian nuclear scientist to provide deliberately flawed nuclear warhead blueprints to Iranian officials in February 2000.

    Risen wrote in his book that President Clinton had approved the operation and that the Bush administration later endorsed the plan.

    Operation Merlin backfired when the CIA's Russian contact/messenger noticed flaws in the schematics and told the Iranian nuclear scientists. Instead of crippling Iran's nuclear program, the book alleges, Operation Merlin may have accelerated it by providing useful information: once the flaws were identified, the plans could be compared with other sources, such as those presumed to have been provided to the Iranians by A. Q. Khan.

    In late 2010, former CIA officer Jeffrey Alexander Sterling was indicted for allegedly being the source of some of the information in Risen's book, and was convicted of espionage in January 2015. He was convicted and sentenced to 3 1⁄2years in prison.​

    This is how a police state protects “secrets”: Jeffrey Sterling, the CIA and up to 80 years on circumstantial evidence
    January 28, 2015

    Then they charged Sterling for improperly retaining the letter (again, FBI never found it, not in CIA’s possession, not in Sterling’s possession, and Merlin purportedly destroyed his version before anyone could find it in his possession). Then DOJ charged Sterling for leaking the letter to Risen, then charged him for causing Risen to attempt to write a 2003 New York Times article including it, then charged him for causing Risen to publish a book chapter including verbatim excerpts from it (apparently Risen is a better investigator than FBI, because he found a copy): one letter, four more counts under the Espionage Act.

    Altogether, seven counts of spying, for one leak.

    Here’s the really scary part though: the jury convicted Sterling based entirely on circumstantial evidence: there was not one shred of evidence showing Sterling handing Risen classified information on the operation, the Russian asset, or the letter that Risen found but FBI could not.

    Well, now she and Bill have to get past the IRS. I. Other words, the federal government are at war with the Clintonsame. These people are experts at skirting get around the law but they may have left some skid marks and is so, the IRS will find them. But I'm sure they are paying get the best tax attorneys more eyes can buy. Sadly, tax payers are footing the bill for the IRS. If they win the case, taxpayers should get a tax rebate at the expense of the Clintons.
