of course it's not hidden; the idea is for one to believe they've turned it off. if they feel that they have a reason to find it, they will ("suspected terrorist" .. [hey! next time the phone goes missing suggest that some "suspicious characters" were seen in the area that you last used it?])

were they palm springs valley girls, they'd have been in and out with the ladies and nobody left able to explain why they did it!


This kind of conflates two issues. The difference here being consent. If you opt-in or click past the warning messages for location services on your smartphone, you are giving them permission to perform those functions and collect that data according to the EULA/TOS.

If it's activated remotely, which is entirely possible (especially with proprietary, closed source binary blobs that are baseband RTOS), that's without your consent. That kind of abuse of technology is something that would function regardless of what the user believes.

The last few years have had some interesting articles on the second case and there has been quite a few failed attempts to open up cellphones. Unfortunately, if this is a seriously disturbing prospect then the only way to deal with it is to remove the battery of your device or decide not to own one at all with the way things currently look.
