Ferguson Police Officer Justin Cosma Hog-Tied And Injured A Young Child, Lawsuit Alleges

WASHINGTON -- A Ferguson police officer who helped detain a journalist in a McDonald's earlier this month is in the midst of a civil rights lawsuit because he allegedly hog-tied a 12-year-old boy who was checking the mail at the end of his driveway.

According to a lawsuit filed in 2012 in Missouri federal court, Justin Cosma and another officer, Richard Carter, approached a 12-year-old boy who was checking the mailbox at the end of his driveway in June 2010. Cosma was an officer with the Jefferson County Sheriff's Office at the time, the lawsuit states. The pair asked the boy if he'd been playing on a nearby highway, and he replied no, according to the lawsuit.

An Audio Recording of the Michael Brown Shooting Has Reportedly Surfaced

What's thought to be an audio recording of the shooting death of Michael Brown has reportedly surfaced. According to CNN, an unidentified man, who has since been interviewed by the FBI, is said to have managed to record the incident in which Michael Brown was shot by Officer Darren Wilson earlier this month, setting off a national firestorm.

The most notable tidbit from the short recording (and what will become subject to the most immediately scrutiny and parsing) is the existence of two distinct volleys of gunfire from Officer Darren Wilson's weapon. From CNN:

The FBI has questioned a man who says he recorded audio of gunfire at the time Brown was shot by Ferguson police on August 9, the man's attorney told CNN.

ST. LOUIS (AP) — Protests over the fatal police shooting of 18-year-old Michael Brown in suburban St. Louis migrated to the city Tuesday as demonstrators pressed for broad reforms to local and federal law enforcement — including the revival of a proposed civilian police oversight board.

About 100 protesters marched from City Hall to the downtown federal courthouse several blocks away to call attention not only to Brown's death on Aug. 9 but also the fatal shooting of 25-year-old Kajieme Powell by St. Louis police 10 days later. Police have said Powell threatened two officers with a steak knife after stealing two energy drinks and a bag of doughnuts from a convenience store.

Experts: More facts needed on purported audio recording of Michael Brown shooting




“There's that pause, which is what gave me pause, when I first saw it,” Blumenthal told Yahoo News. “It was a pause so there was time to think about it and deliberate. That doesn't mean that I'm saying it helps one side or the other. But I do know that in a 12-second tape, where eight seconds of it is a shooting, a three-second delay is a significant period of time.”

Police officers are subject to different rules about the use of deadly force than ordinary citizens. As my colleague Dara Lind explained at length, a police officer is allowed to use deadly force in two circumstances, both of which require the officer to determine that the target poses a threat to others. The first is when the officer believes that the target is directly threatening him or another person. The second is when the officer has probable cause to believe that the person is a suspect fleeing the scene of a violent felony.

That means that for Wilson's shooting to have been legally justified, he will need to credibly argue that he believed either (1) Brown was threatening his life or someone else's life, or (2) that Brown was fleeing from the commission of a violent felony.
