Not really. Take a look at his skin color.
I've seen them convict for murder without a body.
Driving under the influence doesn't just mean alcohol. A breathalyzer doesn't detect cocaine... or meth.. or heroine.. or weed..
Arizona law says, "It is unlawful for a person to drive or be in actual physical control of a vehicle in this state under any of the following circumstances:
1. While under the influence of intoxicating liquor, any drug, a vapor releasing substance containing a toxic substance or any combination of liquor, drugs or vapor releasing substances if the person is impaired to the slightest degree."
I don't see why they don't have portable breathalyzers though.. unless they want an excuse to detain folks just for the inconvenience of it.
sounds like he failed the physical part of the field sobriety test because of his hip.. and then.. downtown.. he was tested and blew the 0.00..
I don't really see any basis for a lawsuit though. They were wrong, but that's not grounds for a judgement against cops.. especially not in Arizona.
